Missouri wrongful death attorney, James Montee, has resolved a wrongful death claim on behalf of his clients in Miller County, Missouri. The families of brothers Dustin Vaughn and Devin Clark, both killed in an auto accident, and their cousin who survived have settled the wrongful death case and injury claims for $1,000,000.00.
On April 21, 2008, the brothers were riding as passengers in a pickup truck driven by their cousin, Kevin Huckabee. While heading eastbound on U.S. Highway 54 in Camden County, Missouri, a westbound concrete truck attempted a left turn in front of the pickup in which the brothers and their cousin were traveling, causing the pickup to collide with the concrete truck.
The brothers were both died on impact. Huckabee survived, but suffered a broken femur that required surgical intervention, including rodding.
The case was filed in Camden County, Missouri, and venue was later changed to Miller County, Missouri. Mediation was initially unsuccessful. Following mediation, the Defendant agreed to pay the $1,000,000.00 demand. $700,000.00 of the settlement was allocated for the wrongful death claim of Vaughn; $100,000.00 for the wrongful death claim of Clark; and, $200,000.00 for the personal injury claim of Huckabee.
